Terms of service
Last updated: October 17, 2026
These terms cover your use of this website and the services you buy from us. Ember Digital is operated by Antony Anton in Toronto, Ontario, Canada. In these terms, “we”, “us” and “our” mean Ember Digital, and “you” means you or the business you represent.
Using this website
You can browse this site and book a free strategy call at no cost. Please don’t misuse the site, for example by sending spam through the booking form or trying to break or overload it.
The words, design and images on this site belong to us. Please don’t copy them without our permission.
Our services
We offer Google Ads and Meta Ads management, account setup and website design and build. The scope, price and timing for each client are agreed in writing before work starts, through a quote, proposal or invoice. If those written terms differ from these terms, the written terms for your project apply.
Prices and payment
All prices are in US dollars. We invoice through Stripe.
Prices are in US dollars, plus applicable sales tax (for example, HST for Ontario clients).
- Monthly management and optional care plans are billed automatically in advance each month. They’re month to month, with no lock-in and no cancellation fee.
- Setup fees are paid before setup work begins.
- Landing pages and business sites are paid 50% to book and 50% before launch.
- Custom sites are paid 40% to book, 30% at design approval and 30% before launch.
- Ad spend is paid by you directly to Google or Meta from your own ad accounts. We never receive it, so we can’t refund it.
Cancellation and refunds
You can cancel monthly management or a care plan anytime before your next billing date by emailing hello.emberdigital@gmail.com, and you won’t be charged again. Our refund and cancellation policy, which comes with every quote and is available by email on request, explains the details in full. In short:
- Monthly fees are paid in advance and aren’t refunded for partial months. If you cancel after a billing date has passed, your service runs to the end of that paid month. If you cancel before we start any work in your first month, we refund that month in full.
- Setup fees and website deposits are refunded in full before work starts or before kickoff, and aren’t refundable once that work is underway. Milestones you’ve approved aren’t refundable.
- If you cancel a website build partway through, you keep everything you’ve paid for, and you aren’t charged for milestones you haven’t reached.
- We always refund billing errors in full. If we don’t start agreed work within 10 business days of the agreed start date, or we miss something we promised and don’t fix it within 10 business days of you telling us in writing, we refund the affected period or the part we didn’t deliver. If we end the service, we refund any unused paid period. In these cases, we cover any payment-processing fees.
Please contact us before disputing a charge with your bank. We’d rather fix it directly.
Ownership
You own everything. Your ad accounts and data stay in your name, and we work in them only through our manager access, which you can remove at any time. Your domain and hosting are set up in your name, and once a website build is paid in full, you own its code. Every build includes a short guide and a 30-day window for bug fixes after launch. New features or design changes after handoff are quoted separately.
What we can’t promise
Advertising results depend on things outside our control, such as your market, your competition, your offer, your budget and the ad platforms themselves. We don’t promise specific leads, sales, rankings or returns, and we don’t give refunds based on results alone. What we do promise is to do the work we agreed to, carefully and on time.
Limit of liability
To the extent the law allows:
- We aren’t responsible for the results of ad campaigns, or for decisions, changes, policies, suspensions or outages at Google, Meta or other platforms we don’t control.
- We aren’t responsible for indirect losses, such as lost profits or lost business.
- Our total responsibility for any claim related to our services is limited to the fees you paid us in the 3 months before the claim.
Nothing in these terms limits any right you have under the law that can’t be limited by agreement.
Privacy
Our privacy policy explains how we handle your personal information.
Trademarks
Google and Meta are trademarks of their owners. We aren’t affiliated with or endorsed by them.
Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts in Toronto, Ontario.
Changes to these terms
If we change these terms, we’ll update the date at the top of this page. The terms in place when you sign up for a service apply to that service unless we both agree otherwise.
